@Yazad

Ever since i stumbled upon your blog while looking for posts on sex and gender..have been thinking about the name..found it familiar..lemme confirm...aint you a friend of Chandrashekhar..you run an NGO..we have spoken on phone.. strange world man...

I have been a part of the Voices against 377 coalition for some time (till the time I moved to Bangalore) so quite glad to see this post...

@ Lokapala

May be its a bit late to respond...

"law is enforced given existing privacy protections."

On what basis do you say that, its a criminal law, you have 3rd party complaint, which means a 3rd party has the right to complaint against what a homo couple is doing behind their closed doors and if one can prove they had anal intercourse, they are guilty. Before the proving part comes the arrest/harassment by police bit..

Imagine, you made love and got arrested.. Isn't that ridiculous? What business has the state got telling how to make love with who so long it is consensual?

Without getting into the pros or cons of striking down the law, its worth noting that the reference to the Universal Declaration of Human Rights is out of context, and rather misleading in general. In fact, the UDHR states that "The family is the natural and fundamental group unit of society and is entitled to protection by society and the State," and much of the debate on homosexuality in the western world has focused on the effect on the family, which is not addressed in the open letter. Clearly, the UDHR by itself is extremely ambivalent on this issue. "Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind." In my reading, Section 377 does not violate the above statement or the freedoms "set forth" in any way, but I'd be interested to hear what specific clauses people believe are being violated, particularly at the level that the law is enforced given existing privacy protections. I'd also be interested to know whether you think privacy protections make the law simply an articulation of a public morality rather than an enforcable restriction, and if so, whether there are any issues with it besides the purely semantic/ideological rather than instrumental ("what message is the government sending?").

You're all a bunch of pretentious ponces, aren't you?

can you tell your precise LEGAL grounds of challenge?

please find me the Constitutional provisions that conflict with the IPC.

please, something more than sanctimonious nonsense and thin gruel that attempt to pass for argument.

Great Guns Yazad Jal,

Good work going. At least the time has come when we have learnt to say a 'no' for a no and raise our voice in symphony for our basic human rights. The list above will go on increasing day by day and a time will come when our lazy government will rise up to repeal the archaic law formed by the britishers (amen).
KEEP IT GOING.

GOOD LUCK
